Latvia's Senate: residents can sue over Biķernieki racetrack noise, but must prove violations

Latvia's Senate has issued a significant ruling in a dispute over car races at the Biķernieki sports complex, clarifying the public's rights to challenge excessive noise as an environmental matter.

The complaint

The case began when several residents challenged a permit issued by the Riga municipality's executive director allowing a road racing championship at the Biķernieki track, citing concerns about excessive noise. A lower court initially refused to accept their complaint, arguing the residents had not proven they were personally affected and were effectively defending others' interests.

The Senate's reasoning

The Senate found this approach incorrect, stating that noise falls under environmental protection issues, not just nature or wildlife protection. As a result, members of the public have the right to go to court to defend general public interests related to the environment, even without proving direct personal harm.

Claim still rejected

Despite recognizing the right to sue, the Senate rejected the residents' specific claim due to insufficient evidence that the event exceeded permitted noise levels. Data submitted from 2018 and 2019 did not relate to the contested event, and publicly available measurements showed noise levels slightly above 58 dB(A) — below the legal limits of 65 dB(A) for mixed-use areas and 60 dB(A) for multi-story residential areas.

The ruling confirms that the public can defend shared interests in a healthy environment through the courts, but a successful case requires specific, up-to-date measurements and evidence rather than general concerns about noise.
