Judge declares mistrial in Lindsay Clancy case

A judge in Massachusetts, William Sullivan, has declared a mistrial in the case of Lindsay Clancy, a mother charged with murdering her three children. The 12-member jury, made up of nine women and three men, could not reach a unanimous verdict, with notes indicating the panel was split 11 to one.

Clancy does not dispute that she strangled her children at the family's home near Boston, but argues she was suffering from postpartum psychosis at the time, which led to her actions. Following the killings, her husband found her injured in the yard after she had jumped from a second-story window, an act that left her paralyzed from the waist down. Prosecutors, however, contended that the 36-year-old former nurse understood what she was doing and acted deliberately.

What happens next

With the jury unable to decide, the case effectively returns to where it stood before the trial began. Clancy remains charged with murder and is being held at a psychiatric hospital while the criminal case awaits resolution.

Prosecutors must now decide whether to pursue a retrial with a newly selected jury, which would mean restarting jury selection, though the specific charges could potentially change. Alternatively, prosecutors could offer Clancy a plea deal. Boston defense attorney Brad Bailey noted that defense lawyers typically explore the possibility of a resolution whenever the threat of a retrial on murder charges resurfaces.

The district attorney's office could also choose not to retry the case, given the possibility that another trial might end the same way, and considering the significant costs involved, particularly for expert witnesses. Clancy's defense team is expected to push hard against a retrial, arguing that she has already suffered greatly through her paralysis and the loss of her three children.

A status conference has been scheduled for 9am ET on 29 September.
